Hearing on showing ex-CJ Khairul Haque arrested in attempted murder, explosives case deferred
Although his lawyers have on several occasions said he would be released following the High Court's grant of bail, he has remained in jail as police have continued to seek orders to show him arrested in new cases.
A Dhaka court today (6 July) deferred the hearing on an application to show former chief justice ABM Khairul Haque arrested in a case filed under the Explosives Act and on charges of attempted murder, setting 8 July as the next date.
Dhaka Additional Chief Metropolitan Magistrate Md Sefatullah passed the order, Sub-Inspector Moktar Hossain of the Dhaka Metropolitan Police's Prosecution Division confirmed.
He said the investigating officer, Banani Police Station Sub-Inspector Saiful Islam, submitted the application on 2 July seeking to show Khairul Haque arrested in the case. The court then fixed today for the hearing in the presence of the accused.
"However, as the case records were unavailable during the hearing, the court deferred the matter and fixed 8 July for the next hearing, which will be held virtually," Moktar said.
Police arrested Khairul at his residence in Dhanmondi on 24 July last year. He has remained in custody since then.
Although his lawyers have on several occasions said he would be released following the High Court's grant of bail, he has remained in jail as police have continued to seek orders to show him arrested in new cases.
According to the case statement, protesters were demonstrating in front of the Mahakhali Setu Bhaban on the afternoon of 4 August 2024 during the July Uprising.
As they marched towards Shahbagh, they allegedly came under attack and were fired upon, while cocktails and crude bombs were also thrown at them. Ujjal Mia and 25 to 30 others were injured in the incident.
Following the attack, Ujjal Mia filed a case at Banani Police Station on charges of attempted murder and under the Explosives Act.
On 28 April, the Appellate Division upheld Khairul Haque's bail in five cases, including those related to the killing of a Jubo Dal activist during the July Uprising, alleged forgery of the caretaker government verdict, and cases filed by the Anti-Corruption Commission (ACC).
He is currently on bail in all eight cases filed against him.
Police have now sought to show him arrested in the newly filed attempted murder and explosives case.
