High Court clears way for BNP's Sarwar Alamgir to take oath as MP for Chattogram-2
On 2 July, the court concluded hearings on the rule and set 9 July for the verdict.
The High Court today (9 July) declared the candidacy of BNP leader Sarwar Alamgir valid, clearing the way for him to take oath as a member of parliament for the Chattogram-2 constituency in the 13th parliamentary election.
The High Court bench of Justice Fahmida Quader and Justice Md Asif Hasan delivered the verdict, declaring the rule issued in this regard absolute.
On 2 July, the court concluded hearings on the rule and set 9 July for the verdict.
Senior lawyers Ahsanul Karim and Barrister AM Mahbub Uddin Khokon represented the petitioner. At the same time, Senior Advocate Shishir Manir and Azim Uddin Patwari appeared for Jamaat-e-Islami candidate Md Nurul Amin.
Nurul Amin challenged the returning officer's decision to validate Sarwar Alamgir's nomination, alleging the BNP candidate was a loan defaulter.
Following a hearing, the Election Commission cancelled Sarwar's candidature on 18 January.
Sarwar then filed a writ petition, and the High Court on 27 January stayed the decision, allowing him to contest the election.
The Appellate Division later allowed him to contest but ordered that his result remain suspended pending disposal of the appeal.
Although Sarwar won the Chattogram-2 seat in the 12 February election, his result was withheld in line with the court's directive.
On 16 June, the Appellate Division disposed of Nurul Amin's appeal and directed the High Court to settle the pending rule within two weeks.
With today's verdict upholding his candidature, the legal barrier to Sarwar Alamgir taking oath as an MP has been removed.
