Court intervention legitimate way to settle tax disputes, not evasion: AMTOB

The Association of Mobile Telecom Operators of Bangladesh (AMTOB) has expressed concern over media reports claiming that mobile operators owe large sums of money to the government, saying the reports do not reflect the legal and regulatory complexities involved.
In a statement issued today (25 June), AMTOB said a significant portion of the claimed amount relates to unresolved value-added tax (VAT) disputes and differing interpretations of regulatory and licensing provisions.
The association said mobile operators have long faced difficulties in obtaining Mushak Challans from the Bangladesh Telecommunication Regulatory Commission (BTRC) after making payments, preventing them from claiming VAT rebates and input tax credits allowed under the law.
AMTOB also opposed the imposition of VAT on revenue-sharing arrangements, arguing that it could result in double taxation as VAT has already been applied within the value chain.
The association said the disputes involve complex tax interpretations that require judicial review, and alleged that misinterpretations of licence conditions during audits have inflated the claimed dues.
It added that seeking court intervention is a legitimate process for resolving such disputes, not an attempt to evade obligations.
"Regulatory and taxation disputes should be addressed through constructive engagement, transparent processes and adherence to the rule of law," the statement said.
AMTOB said mobile operators remain committed to fulfilling their lawful obligations and working with regulators and tax authorities to resolve outstanding issues, while urging respect for investors' legal rights.
It said a fair and predictable regulatory environment is essential for the telecom sector's growth and for attracting foreign investment.
AMTOB added that the telecom sector is one of the country's largest revenue contributors and continues to invest billions of dollars in network infrastructure, digital connectivity and technology.
The association said operators have consistently met their obligations and remain committed to supporting Bangladesh's digital transformation.
