Chamber court suspends HC order requiring association certificate for betel leaf exports
The Appellate Division’s chamber court stayed the High Court order that made a Bangladesh Betel Leaves (Pan) Exporters Association certificate mandatory for exporting betel leaf.
The Appellate Division's chamber court today (4 October) suspended a High Court order requiring exporters to obtain a certificate from the Bangladesh Betel Leaves (Pan) Exporters Association before exporting betel leaf from Bangladesh.
Attorney General Barrister Md Ruhul Quddus Kajal said the order means there is currently no legal restriction on exporting betel leafwithout the association's certificate.
Chamber Judge Justice Rezaul Haque passed the order following a petition filed by the state challenging the High Court order.
On 6 August, a High Court bench, acting on a petition filed by the Bangladesh Betel Leaves (Pan) Exporters Association, had ordered that betel leaf could not be exported without a certificate from the association.
The order effectively made the association's certificate a mandatory requirement for betel leaf exporters.
The Ministry of Commerce challenged the order before the Appellate Division through the director general of the Directorate of Trade Organisations.
Following today's hearing, the chamber court stayed the operation of the 6 August High Court order. As a result, exporters are not currently required to obtain the association's certificate, pending further proceedings.
Attorney General Ruhul Quddus Kajal represented the Ministry of Commerce, assisted by the ministry's lawyer Advocate Md Tajul Islam.
Senior lawyer Barrister Fida M Kamal and Advocate Faisal Mohammad Faizee represented the Bangladesh Betel Leaves (Pan) Exporters Association.
